Terms and Conditions of Labee Advocatuur
Terms and conditions applicable to agreements and services between Labee Advocatuur and the client.

1. Applicability
1.1 All assignments are, notwithstanding Articles 7:404 and 7:407(2) of the Dutch Civil Code, accepted and carried out exclusively by S.A.A. Labee, Esq., acting under the name Labee Advocatuur.
1.2 These general terms and conditions apply to all agreements between Labee Advocatuur and the client, as well as to all work and legal relationships arising therefrom.
1.3 All legal relationships are governed exclusively by Dutch law.
2. Agreement
2.1 Labee Advocatuur will make every effort to perform the agreement with care and expertise, without guaranteeing the intended result.
2.2 The client shall provide all relevant information in a timely manner and guarantees its accuracy.
2.3 Both the client and Labee Advocatuur may terminate the agreement before its expiration.
3. Fees and Payment
3.1 Unless otherwise agreed, work is generally performed on the basis of an hourly rate, plus VAT and third-party costs.
3.2 Payment must be made within 14 days of the invoice date.
3.3 In the event of late payment, statutory interest will be charged, and collection fees may be applied.
4. Complaints and Disputes
4.1 In the event of a complaint, the kantoorklachtenregeling provided by Labee Advocatuur will be followed.
4.2 If a dispute cannot be resolved amicably, it may be brought before the competent court.
5. Liability
5.1 Claims must be reported in writing without delay, stating the grounds for the claim.
5.2 Any liability is limited to the amount paid out in the specific case under the professional liability insurance, plus the deductible. The insured amount is €1,000,000 per claim.
5.3 Labee Advocatuur is not liable for indirect or consequential damages.
5.4 If third parties are engaged, Labee Advocatuur is not liable for their errors.
5.5 Labee Advocatuur’s liability is limited to the amount covered by its insurance policy.
6. Data Protection
6.1 Labee Advocatuur processes personal data in accordance with the GDPR.
6.2 The client provides the information necessary to comply with legal obligations, including the Wwft.
