The Case
A major subcontractor was involved in the construction of a tank terminal in the Port of Rotterdam. It was an international project involving substantial sums of money. At one point, the general contractor refused to pay outstanding invoices and claimed that nothing more was owed.
What Was at Stake
It was a substantial amount that had a direct impact on the subcontractor’s cash flow. Not being paid on a project of this size affects the entire operation.
The Strategy
On behalf of the subcontractor, I filed a lawsuit with the Rotterdam District Court. The focus was on the contractual agreements and the payment obligations that unambiguously arose from them. I analyzed and refuted each and every one of the general contractor’s defenses.
The result
The court ruled unequivocally: all invoices had to be paid. Every objection raised by the general contractor was rejected. The subcontractor received what he was entitled to, and cash flow was restored.
